On Tuesday, September 5, 2012, Irvine Police detectives arrested Chiropractor, Dennis Scott Durbin, at his Irvine office (Sky Park Chiropractic) for two felony assault charges after a patient reported being touched in an inappropriate and sexual manner during a therapeutic massage.

A female patient has claimed that during an adjustment Mr.

Durbin sexually assaulted her. Mr. Durbin has denied the allegations. After his arrest he was being held on 0,000 bail.

The question in this case will be whether the allegations can be proven beyond a reasonable doubt. There are almost never any witnesses to such alleged crimes other than the medical provider and the patient. The prosecution will argue that the alleged victim has no motive to make up the allegations. The defense will likely argue that no inappropriate touching took place and that whatever touching took place it was part of the appropriate medical protocol.
